City Council - Record of Decision
I, Councillor McCusker, Lead Member for Planning, Transport and Sustainable
Development, in exercise of the powers contained within the Council
Constitution, do
hereby:
Authorise the making of the Traffic Regulation Order
below, in the modified form as set out in the report, subject to
the further modification agreed at the Lead Member Briefing,
removing the restrictions that had been proposed at the end of the
industrial estate, as set out in the plans at Appendix 5 of the
report.

The Reasons are: That the
necessary action be taken under the Road Traffic Regulation Act
1984 to advertise the intention to make the Traffic Orders to
introduce ‘City of Salford (Lynwell Road and Old Wellington Road, Eccles)
(Prohibition of Waiting) Order and Revocation 2024’ to
create safer environment for all road users.
Further to representations made
by an objector at the Lead Member Briefing indicating that (a) the
road is not a through-road as it is only used by tenants and
clients / suppliers attending the estate, and (b) whilst the need
for the proposed restrictions at the entrance to the estate is
accepted, the proposed restrictions towards the end of the
industrial estate would negatively impact the operation of the
estate, further modification to the scheme was agreed, as set out
in the plans at Appendix 5 of the report.
Options considered and
rejected were: As set out in the report.
Assessment of Risk: The
restrictions will be signed in accordance with the Traffic Signs
Manual and Traffic Sign Regulations and General Directions. (TSRGD
2016).
The source of funding
is: The scheme is funded from CRSTS funding for Eccles in 2024-2025
finance year.
Legal Advice
obtained:
The Council, by virtue of the Road Traffic
Regulation Act 1984 can introduce orders to manage traffic. Where
Traffic Regulation Orders are required, they should not give rise
to any particular legal implications provided the works and
procedures are carried out in accordance with the relevant
statutory requirements, which would include the consideration of
any objections to a proposed Traffic Regulation Order.

Highways Devolved Budget for Eccles in 2024/2025 financial year.
Further financial scrutiny will be carried out at the DDN
stage.
