Salford City Council - Record of Decision
 
I, Councillor Mike
McCusker, Lead Member for Planning, Transport and Sustainable
Development, in exercise of the powers contained within the Council
Constitution, do hereby:
 
 i.              
Approve the draft Holcroft Moss SPD attached at
Appendix 1 of the report, and supporting documents, as the basis
for a six-week public consultation commencing no earlier than 1
November 2024.
 
ii.              
Delegate approval to the Executive Director of Place
to make minor, non-material modifications to the draft Holcroft
Moss Supplementary Planning Document before consultation commences,
subject to consultation and agreement with the eight other Places
for Everyone authorities.
 
The Reasons are that
through the Habitats Regulation
Assessment (HRA) process in support of the PfE Plan (and also the recently adopted Warrington
Local Plan), the Manchester Mosses Special Area of Conservation
(SAC), and in particular Holcroft Moss, has been identified as
being at risk of harm from increased air pollution caused by the
cumulative impact of traffic resulting from development in the
Warrington Metropolitan Borough Council (WMBC) area and the
PfE Plan area. To mitigate against this
harm, there is a need for the delivery of long-term ecological
resilience works, involving hydrological restoration measures to
benefit Holcroft Moss. The SPD provide guidance on, and will
facilitate, the timely provision of the mitigation required at
Holcroft Moss.
 
Assessment of Risk is low.
The draft SPD supplements
policy in the adopted PfE Joint
Development Plan Document. Consulting on the draft SPD will give
consultees the opportunity to comment on the draft before it is
finalised and adopted.
 
The source of funding for the consultation and associated printing and
postage  will be met from existing
revenue budgets.

Under the Town and Country
Planning (Local Planning) (England) Regulations 2012, compliance is
required with the consultation process in relation to a proposed
Supplementary Planning Document (“SPD”).
 
Regulations 12 and 13 require
that the draft SPD together with associated documents is made
available for public consultation for a period not less than four
weeks.
 
The Places for Everyone
(“PfE”) Plan local planning
authorities need to ensure that its SPDs and other policy documents
are consistent with the recently adopted PfE Joint Development Plan to prevent the risk of
any legal challenge.
 
Financial Advice obtained from:
Martin Anglesey, Accountant
Revenue funding exists in
financial year 2024/25 on Cost Centre D4602 to cover the
publication and communication costs. This is expected to be limited
to postage and printing (50 pages in total) so the total
expenditure should be negligible, approximately
£250.
 
The £880K mitigation
costs mentioned within the report will be funded by developers
across the relevant GM districts and the area covered by Warrington
Borough Council, and so will not be funded from Salford City
Council’s budget i.e. Salford will not be liable for any of
these costs.
 
Project Innovate is not
applicable due to the unique nature of the scheme.
