When commissioning
contracts for the procurement of goods, services or the execution
of works, the Council must comply with the requirements of the
Public Contracts Regulations 2015 (PCR) and its own Contractual
Standing Orders (CSO’s) failing which the decision may be
subject to legal challenge from an aggrieved provider. CSO’s
stipulate that where a suitable framework exists, this must be used
unless there is an auditable reason not to do so.
A framework is an
overarching agreement through which named user organisations can
require a service/supply from a number of providers by undertaking
a call off exercise to meet its requirements by further competition
or direct award as applicable and enter into an individual
contract/agreement with that provider, according to the terms of
the framework agreement within the lifespan of the framework. A
contract will be formed between the Council and chosen provider
based on the call off contract terms specified in the
framework.
The YPO Framework
allows public bodies to use it and the Council should ensure that
it has complied with the requirements of the framework in awarding
this contract to Amazon UK Services Ltd. The YPO Framework complies
with the PCR and CSO’s. The award also delivers savings
and efficiencies as detailed in the report.

The report is seeking
the appointment of Amazon UK Services Limited for a period of 29
months with an average spend of £72,000 per annum.
The spend comes within
the general revenue spend of each Directorate and all such spend is
managed in accordance with the authorisation limits set within the
Constitution. In addition, all revenue spend is monitored by the
relevant accountant and the service lead for that area to ensure
that it is managed appropriately and comes within budget
expectations.

YPO’s Amazon Digital
Marketplace 1142 is a fully OJEU compliant framework (2023/S
000-000469). There is one supplier on
the framework and the call-off method is direct award
only.
