Salford City Council - Record of Decision
I,
Councillor Mike McCusker, Lead Member for Planning, Transport and
Sustainable Development, in exercise of the powers contained within
the Council Constitution, do hereby:
(i)
accede to the objections in part;
(ii)
approve the modifications to the scheme, as set out
in the report, together with the additional modifications agreed at
the Lead Member Briefing, removing the proposed restrictions in
front of 82-84 Campbell Road and reducing the proposed restrictions
in the vicinity of 66 Rolag Crescent, as set out in the additional
Appendices 5 and 6 to the report; and
(iii)
authorise the making of the Traffic Regulation Order
in the modified form.
The Reasons are: That the necessary
action be taken under the Road Traffic Regulation Act 1984 to
advertise the intention to make the Traffic Order to introduce
CITY OF SALFORD (CAMPBELL ROAD AREA, SWINTON PARK) (PROHIBITION
OF WAITING) ORDER 2024. as a permanent
Traffic Order.
Implementation of the Traffic Order would allow enforcement of
waiting restrictions, should it be
required. Which are required to maintain access in to and out of
the New Campbell Road development, in the vicinity of the new raise
table top road hump and at either end of Thorn Road to ensure safe
access and visibility at these junctions for all road
users.
Options
considered and rejected were: Waiting
restrictions are the only option that can ensure sight lines and
access can be maintained and enforcement can be carried out should
it be necessary.
Following
consideration of representations made by ward councillors on behalf
of local residents, it was agreed that the proposed scheme would be
further modified as indicated above, as set out in the additional
Appendices 5 and 6 to the report.
Assessment of Risk: The restrictions
will be signed in accordance with the Traffic Signs Manual and
Traffic Sign Regulations and General Directions (TSRGD
2016).
The source of funding:
Developer.
Legal Advice obtained: The Council, by
virtue of the Road Traffic Regulation Act 1984 can introduce orders
to manage traffic. Where Traffic Regulation Orders are required,
they should not give rise to any particular legal implications
provided the works and procedures are carried out in accordance
with the relevant statutory requirements, which would include the
consideration of any objections to a proposed Traffic Regulation
Order.
