The Planning Committee
resolved that, had the Council been in a
position to determine the application, the Council would
have approved application 08/19/0035, subject to the appellant
entering into a legal agreement to secure the following planning
obligations:

25% of the dwellings
were to be affordable homes.
An education
contribution of £1,604,698.79 (£14,327.67 per dwelling)
towards early years, primary, secondary and SEND education
provision.
An NHS contribution
of £50,028 towards additional GP space in the
locality.
£234,062
towards sustainable transport improvements in the north of Taunton,
including consideration of highway works in the vicinity of Cheddon
Fitzpaine Primary School.
Maintenance of the
open space, play areas and SuDS
(Sustainable Drainage Systems) to mitigate flood risk and phosphate
output.
A Travel Plan and
future monitoring.
Amendment of
condition 3 to add section (d), requiring bungalows in the northern
parts of the site in general accordance with the amended framework
plan.
Imposition of an
additional sustainability statement condition.
