Purpose

Report seeking approval to amend the Council's Constitution and Planning Scheme of Delegation to implement the requirements of the National Scheme of Delegation and associated planning governance reforms.

Decision

The Cabinet has considered a report detailing proposed changes to the Scheme of Delegation and related sections of the constitution to reflect the requirements of the Planning and Infrastructure Act 2025 and which set out by the Town and Country Planning (Discharge of Local Planning Authority Functions) (England) Regulations 2026 that included the implementation of a national scheme of delegation for the consideration of planning and related applications, and has agreed to recommend that the Council Meeting approves and adopts the proposed changes required to the constitution to reflect the introduction of the National Scheme of delegation.

Alternative options considered

The Council is required to comply with the Town and Country Planning (Discharge of Local Planning Authority Functions) (England) Regulations 2026, which introduce a mandatory national scheme of delegation there are no other alternative options available.
