Purpose

Proposal to allow a wayleave in
Elizabeth House with associated works for Virgin Media to provide
an upgraded service for the Council’s tenant,
Exeid.

Content

That the Council will grant the
wayleave and a works licence.

Reasons for the decision

The service provided by the
wayleave will allow the Council’s tenant to provide improved
Wi-Fi to their licencees. The cabling will be sited in the lower
ground floor of Elizabeth House and won’t interfere with the
Council’s operational use of the building.  The Council may be able to end the agreement on
giving Virgin Media 18 months’ notice, which is required by
law, but Virgin Media can then apply to the court to retain its
equipment and the rights granted.  These
rights are embedded in law for telecoms operators, and the Council
is limited in any other action it is able to take.
 
The draft agreements have been
approved by Legal Services, and the works have the support of
IT.  The Council’s costs will be
covered.
