Purpose

The documents approved in the
decision notice dated 4 December 2023 to 1) vary the headlease of
temporary accommodation properties granted to Stratford-on-Avon
District Council (SDC) by Orbit Housing Association Limited and
dated 21 March 2018 and 2) to grant a revised sublease to the
provider of SDC’s temporary accommodation services contract;
have not been completed to delays caused by Orbit.
 
The following has now taken
place:

1)  
The headlease of temporary accommodation properties
granted to SDC by Orbit Housing Association Limited and dated 21
March 2018 has expired; and

2)  
The temporary accommodation services contract is to
be extended until 1 December 2024.
 
Owing to the above, the subject
of this decision notice is to enter into
a short-term extension of the headlease, grant a revised sublease
(of Orbit owned properties) and a revised lease (of SDC owned
properties) to the provider of SDC’s temporary accommodation
services contract.

Content

To enter into a short-term
extension of the expired headlease whilst the terms of a renewal
headlease from Orbit are being agreed. The extension headlease will
be on the same terms as the expired lease save that it will also
include the premises known as 22, 24 and 26 Clopton Road but
exclude the property known as 27 Little Park. The term of the
extension lease will commence on 5 March 2024 and will expire when
the renewal headlease is completed (expected to be beginning of May
2024).
 
To grant a revised sublease (of
Orbit owned properties) which: excludes 27 Little Park and includes
22, 24 & 26 Clopton Road; includes additional clauses to
protect SDC and grants a longer occupation until 1 December
2024.
 
To grant a revised lease (of
SDC owned properties) which includes additional clauses to protect
SDC and grants a longer occupation until 1 December
2024.
