Grant a licence to assign the
lease.
Reasons for the decision
The tenant has requested a
licence to assign their lease. The lease requires the Council to
act reasonably with regard to this request. The previous assignee
dropped out and the tenant is now proposing an assignment to a new
assignee.
A credit check of the proposed
new tenant has been carried out and they are standing as guarantor
with a six months’ rent deposit as well as providing a
guarantor. The current use will continue as a shop and café.
All terms of the lease remain as current.
All repairs and other
obligations to be carried out under the lease have been completed
satisfactorily by the current tenant.
The Council’s legal costs
are being covered by the current tenant and the Council’s
interests are being protected as the licence to assign is being
drafted and agreed by Legal Services.
Alternative options considered
As the proposed assignee of the
lease is fulfilling due diligence and repairs have been completed,
the Council has no other options but to agree to the licence to
assign, under the Scheme of Delegation in the constitution (Para 4
relating to delegations to the Deputy Chief Executive).
