DETERMINED

That funds be
allocated from the sale price of the Former Hyde Library site for
the removal of Japanese Knotweed to allow for the sale to Forts
Development to complete.

Reasons for the decision

Following marketing of the site,
Asset Management Panel on the 31 July 2024 approved the sale of the
former Hyde Library site to Forts Developments.  The site was put under contract, subject to
planning.  Planning was granted on 25 July
2025.  The sale is due to complete
shortly.  However, Japanese Knotweed has been identified
on the site.

Japanese knotweed is covered under
the Wildlife and Countryside Act 1981, rev. 2, meaning that it is
an offence to plant or otherwise cause to grow.

The Knotweed, therefore, must be
removed at the cost to the Council.

Alternative options considered

Do Nothing – the sale of the
site may not proceed.
