That the Council
be given approval to grant consent for the proposed sub-letting to
Henshaws Building and Roofing Supplies Limited.
Reasons for the decision
The subject property was previously
let to Topmix Limited by virtue of a 99-year lease dated 1 April
1981. In February 2023, Thornway Investments Limited
acquired the leasehold by way of an assignment with circa 55 years
remaining on the lease. Thornway Investments Limited is now the
Council’s Tenant, paying a ground rent of £15,800 per
annum.
The Tenant has now submitted an
application to sublet the whole of the property to Henshaws
Building and Roofing Supplies Limited. The tenant is entitled to sublet the property
as is set out within the terms of their lease, provided they obtain
written consent from the Council, where such consent is not to be
unreasonably withheld.
The Tenant has also requested
consent for alterations, which will be dealt with within the same
documentation.
The tenant will be responsible for
payment of the Council’s legal and surveyor’s fees
totalling £1,750.
Alternative options considered
Refusing consent - If the Council
decided to refuse consent, this would be a breach in covenant, and
the Council would be acting unreasonably.
