Purpose
Tameside Council is introducing a Section 19
Policy to ensure compliance with statutory duties under the
Education Act 1996 and provide suitable education for children
unable to attend school due to illness, exclusion, or other
reasons. The policy establishes a Section 19 Panel to oversee
referrals, improve governance, and ensure consistent, timely
provision. Approval is sought for immediate implementation to
strengthen inclusion and reduce the risk of legal
challenge.
Content
That the Proposed
Section 19 Policy be approved for immediate implementation,
ensuring that the local authority can meet its statutory duties
under the Education Act 1996 and respond effectively to the
increasing number of children unable to access
education.
Reasons for the decision
To formally introduce a Section 19
Policy.
Alternative options considered
To continue to operate without an
established Section 19 Policy at the risk of legal challenge and
adverse effects on children and young people.
