EQUIVALENT FOOD PROVISION, AND CHILDREN IN RECEIPT OF EDUCATION OTHERWISE THAN AT A SCHOOL (EOTAS)
September 30, 2026 Executive Cabinet (Other) Key decision In call-in window View on council websiteFull council record
Purpose
This report outlined changes to DfE non-statutory Free School Meals Guidance as updated March 2024 which included new guidance on children receiving education otherwise than at school (EOTAS). Whilst it was not a statutory requirement, the DfE expected local authorities to consider making equivalent food provision (EFP) for children with an EHCP, receiving EOTAS under section 61 of the Children and Families Act 2014 and have no provision named in section I of their final EHCP and would otherwise be eligible for a Free School Meal if attending on roll at a school.
Decision
RESOLVED
That Approval be given to put the processes in place as detailed in this report to provide equivalent food provision to children with an EHCP receiving education other than in a school under section 61 of the Childrens Act 2014 who would meet the criteria for a benefits-related free school meal if attending a school as outlined in DfE non-statutory Free School Meals Guidance as updated March 2024.
Alternative options considered
To not provide equivalent food provision at all.
