Decision

Unauthorised use of timber lodge, erection of structure, erection of extension and new driveway - the non-compliance with an occupancy condition relating to the planning permission (reference 13/00608/COU) granted for the use of land for siting of gypsy/traveller pitch.

Since the publication of the updates sheet, the application submitted to vary the occupancy condition had been validated.

RESOLVED

Should the application to vary the occupancy condition be refused and the unauthorised occupation of the mobile home continues, delegated authority be granted to the Head of Development Management in consultation with the Chair of the Committee to issue a Breach of Condition Notice under Section 187A of the Town and Country Planning Act 1990 to:

Ensure the conditions imposed upon planning consent 13/00608/COU are complied with and the mobile home is only occupied by gypsies / travellers in accordance with the planning permission, within 3 months.

In the event of the Notice not being complied with, within 3 months, the Solicitor be authorised to take further action as necessary under Section 187A of the Act.
