Purpose

To seek authority to consent to the transfer
of open space land at land adjoining Brook Park West, Hartley Brook
Road, Clacton-On-Sea CO16 9FZ also known as Picker’s Ditch
Land directly from Matthew Homes Limited to Tendring District
Council pursuant to paragraph 1.3 Schedule 3 of the Section 106
Agreement dated 7 June 2017 as varied Section 106 Agreement dated 6
April 2023 relating to planning application 16/01250/OUT dated 8
June 2017.
To seek authority to accept the Picker’s Ditch Land
Maintenance Contribution of £75,000 to maintain and manage
the Open Space Land in perpetuity from the date of completion of
the transfer.
To seek authority to consent to completion of a hoarding licence
whereby there is currently hoarding in place, which encroaches onto
the Open Space Land to be transferred to the Council, to allow for
the safe completion of the estate roads along the boundary. The
hoarding will be removed once building of the estate road is
completed.

To complete the transfer of the public open
space in from the Developer to the Council, to accept the
Contribution of £75,000 and to agree for the hoarding to
remain until the estate roads at the development at Brook Road
Hartley are fully constructed and to utilise the Contribution to
maintain the public open space.
