Purpose

A Section 104 Agreement under the Water
Industry Act 1991 between Partner Construction Limited(1) Flagship
Housing Group Limited(2) Tendring District Council and Anglian
Water is needed to allow a drainage connection in accordance with a
previously agreed easement in respect of a development at Kirby
Road, Walton-on-the-Naze

Content

To enter into and complete the S104 Agreement
between Partner Construction Limited, Flagship Housing, Tendring
District Council and Anglian Water.

Alternative options considered

To not agree completion of the Section 104
Agreement is not an option. The works to be carried out by the
developer relates to a development at Kirby Road. The works may
affect the adjoining land owned by the Council and a Deed of
Indemnity will also be entered into between Partner Construction
Limited and the Council to make good any damage to the Council's
land.
