Purpose

To obtain the approval of the Corporate
Director to the terms associated with the granting of a new lease
in respect of 26 Hilltop Crescent, Weeley, a former Council owned
property, in accordance with the Council’s statutory
obligations under the Leasehold Reform, Housing and Urban
Development Act 1993.

Content

That the Corporate Director (Operations and
Delivery), in consultation with Legal Services, authorises the
formalising of this lease extension subject to such other terms as
considered necessary.

Alternative options considered

Option 1 - To agree the terms in connection
with the extension of this lease agreement.
Option 2 - Not to agree to these terms. If the Council failed to
grant a new lease via the statutory route, the leaseholder could
apply to the Court for an order granting a new lease. These could
result in a loss for the Council in terms of the premium payable
for the new lease as well as increased administrative and legal
costs in dealing with the application.
