Purpose

Under the powers delegated to the Director of
Planning and Community, the Environment Act 2021, and powers
relating to entering into an agreement regulating development or
use of land under Ss.106 of the Town and Country Planning Act 1990,
the Council enters into a legal agreement with the landowner of the
site known as Brook Farm, Stones Green Road, Great Oakley for the
provision, monitoring and maintenance, over a 30 year period, of a
Habitat Bank.

To record and monitor the proposal over a 30 year period as
detailed within the S106 agreement.

Alternative options considered

Consideration has been given to LGR, however,
no implications were established as the land falls entirely within
the Tendring District, and each authority is currently undertaking
their own habitat bank procedure.
