To enter into and sign the Basic Asset Protection
Agreement (BAPA) with Network Rail in relation to the felling of
Poplar trees at Walton-on-the-Naze
Railway Station car park (Network Rail Ref: 159333/GER4955 –
ACE0000428485).
This authorises
Tendring District Council to formally execute the agreement and
proceed in accordance with Network Rail requirements.
Reasons for the decision
Entering into the BAPA is required by Network Rail
to ensure appropriate asset protection measures are in place prior
to commencement of the works, which involve tree felling
in close proximity to the operational
railway and overhead line equipment. The agreement sets out
responsibilities relating to safety, design, access, possessions,
insurance and compliance with relevant standards.
This is necessary
to allow the Council’s project to progress lawfully and
safely
Alternative options considered
Do not sign the
BAPA – Rejected. The works cannot legally or safely
proceed without Network Rail’s formal asset protection
agreement.
