That penalty charges for breaches of the Energy Efficiency (Private
Rented Property) (England & Wales) Regulations 2015 be
APPROVED as follows:
 
·        
Failure to comply with a compliance
notice.

First occasion = £1,000
§ 
Second and any subsequent occasions = £2,000
(statutory maximum)
 
·        
Provision of false or misleading
information
§ 
First occasion = £500
§ 
Second and any subsequent occasions = £1,000
(statutory maximum)
 
·        
Letting a property in breach of the regulations for
less than 3 months
§ 
First occasion = £1,000
§ 
Second and any subsequent occasions = £2,000
(statutory maximum)
 
·        
Letting a property in breach of the regulations for
more than 3 months
§ 
First occasion = £2,000
§ 
Second occasion = £4,000 (statutory
maximum)

That penalty charges for breaches of the Electrical Standards in
the Private Rented Sector (England) Regulations 2020 be
APPROVED as follows:
 
·        
Failure to supply a certificate to the Council
following a formal request to do so:
§ 
First occasion = £500
§ 
Second and any subsequent occasion =
£1,000
 
·        
Failure to ensure that an inspection/test was
carried out by the required date.
§ 
First occasion = £500
§ 
Second and any subsequent occasions =
£1,000
 
·        
Failure to comply with the requirements of a
remedial notice.
§ 
First occasion = £5,000
§ 
Second occasion = £10,000
§ 
Any subsequent occasion =
£20,000
 
·        
Failure to carry out urgent remedial action within
the specified period.
§

§
