Decision

Consideration was given to the adoption of a revised Civil Penalties Policy (Annex 1) which was based on the nationally recognised Association of Chief Environmental Health Officers framework and had been updated to reflect the enforcement framework introduced by the Renters’ Rights Act 2025.

Key changes included incorporation of new civil breaches, recognition of new and amended offences, updated maximum penalty levels and retention of a structured penalty-setting methodology.  Cabinet noted that the revised Policy would strengthen the Borough Council’s ability to enforce housing standards and regulate the private rented sector. 

Due regard was given to the financial and value for money considerations, the legal implications and the assessment of risk.

In recognition of maintaining effective enforcement arrangements and protecting residents, Cllr Mehmet proposed, Cllr Keers seconded and Cabinet

RESOLVED: That

(1)            the revised Civil Penalties Policy (Housing), attached at Annex 1, be approved and adopted; and

(2)            the authority to make minor updates to the policy, where necessary, be delegated to the Director of Planning, Housing and Regulatory Services in consultation with the Cabinet Member for Housing, Environment and Economy, provided these do not materially alter its intent.
