RESOLVED: Cabinet resolved to
make a PSPO in the same terms as the draft Order at Appendices A
and B for a period of three years.
REASONS RESOLVED:
1.
Residents, businesses and road users in West
Northamptonshire have been and continue to be detrimentally
impacted by a range of anti-social vehicle related activities
taking place on roads and other public places across the WNC area
for a number of years, as can be seen from some of the consultation
responses at Appendix C and the Police representations at
Appendices D and E.
2.
This Order would allow the Council and
Northamptonshire Police to try and tackle some of these activities
more effectively and remove or reduce their impact on residents,
businesses and road users. As the prohibited activities set out at
Appendix E are not criminal offences in their own right, the
ability of the Police and WNC to try and effectively achieve that
is currently limited.
3.
Making the Order at Appendix A for these reasons
would be consistent with the legal tests set out in the 2014 Act
for making a PSPO.
ALTERNATIVE OPTIONS:

Resolve that the Council will make an Order
prohibiting all of the activities set out in the draft Order at
Appendix A in the Restricted Area set out in the plan at Appendix B
in the and delegate the power to make that Order to the Executive
Director for Communities and Opportunities upon completion of the
remaining necessary statutory requirements,

Resolve that Council will make an Order prohibiting
some of those activities in the Restricted area at Appendix B and
delegate the same powers to the same person,
·
Resolve that the Council will make an Order
prohibiting all or some of those activities in a smaller Restricted
Area or Areas within the larger WNC area and delegate the same
powers to the same person or
·
Refuse to resolve that WNC will make an
Order.
