RESOLVED: Cabinet endorsed the
proposed approach to the use of powers under Part 10 of the
Levelling up and Regeneration Act 2023 set out in Appendix
A.
 
REASONS RESOLVED:
1.    
To provide a clear framework within which the HSRA
process can be operated by the Council.
2.    
To seek to secure maximum benefit from the new
powers whilst minimising cost and risk, interference with the
normal operation of the
 
ALTERNATIVE OPTIONS:
 
Option 1: The Council could
decide it does not wish to make use of these powers. It might, for
example, consider the costs and risks to taxpayers too high, or
that is disapproves of the interference with private property
rights involved in the scheme. The use of the powers is
discretionary, so provided the Council’s decisions were
reasonable it could follow this course of action.
 
Option 2: The Council could use
the powers in an ad hoc way, when a particular issue was
identified.
 
Option 3: The Council could put
in place a set of arrangements designed to balance the different
interests.
