Decision

RESOLVED at Cabinet:

a.     Confirmed their ongoing support for the Moving Traffic Enforcement programme and 

b.     Confirmed their support for the locations identified where additional Moving Traffic Enforcement will be undertaken as set out in Section 5 below. 

REASON RESOLVED:

1. It is the duty of a local traffic authority to both a) exercise their road traffic regulation powers so as to secure the expeditious, convenient, and safe movement of traffic1; and b) to manage their road network with a view to achieving, so far as may be reasonably practicable having regard to their other obligations, policies and objectives, the expeditious movement of traffic on the authority's road network.2 
2. The action which the authority may take in performing such duties includes, in particular, any action which they consider will contribute to securing  

a) the more efficient use of their road network; or 

b)  the avoidance, elimination or reduction of road congestion or other disruption to the movement of traffic on their road network

1. By using the powers confirmed to enforce moving traffic offences we are complying with our statutory duties to secure the expeditious, convenient, and safe movement of traffic, and the more efficient use of the road network by and reducing unnecessary congestion due to vehicles making illegal movements or blocking junctions by stopping in yellow boxes.  
2. The lack of enforcement at the proposed locations have allowed drivers to ignore the restrictions and cause an impact on the network especially at peak times. 

ALTERNATIVE OPTIONS:

The decision could be taken not to implement enforcement at any of the sites which would result in none of the benefits of the proposed enforcement being achieved.
