Decision

The Assistant Director of Property and Investment has approved the award of a contract for CDM Principal Designer and Building Regulations Principal Designer Advisory Services to Keelagher Okey Associates Limited (Company Number 04390026) as the highest scoring tenderer in accordance with the most economically advantageous tender criteria. for a fixed term of 24 month at an estimated contract value of £450,000.

Reasons for the decision

The contract is to provide CDM Principal Designer/CDM Advisory Services and carry out all the duties as per the Construction (Design and Management) Regulations 2015. In accordance with Regulation 11(1), also to carry out all the duties of Building Regulations services as required by The Building Safety Act 2022.

This service was commissioned via Fusion 21 Consultants Framework, Lot 10 – Principal Designer Duties, using a further competition, which was conducted in accordance with Council’s Contract Procedure Rules and the Public Contracts Regulations 2015

A detailed specification with tender documents were issued all consultants within the lot in April 2025 and a tender exercise was undertaken. Three compliant bids were received. The bids were scored on a Price/Quality/Social Value basis.

• Price – 50%
• Quality – 40%
• Social Value – 10%

The bids were scored on a most economically advantageous tender basis with Keelagher Okey Associates Ltd being the highest scoring tenderer
Appendix 1 to this report set out a summary of the scoring exercise carried out in respect of the tenderers.

Appendix 1 is exempt from publication pursuant to paragraph 3 of the part 1 of Schedule 12 A of the Local Government Act 1972 (Information relating to the financial or business affairs of any particular person (including the authority holding that information)) because it contains or refers to information relating to the financial and business affairs of the Council and the tenderers and the public interest in maintaining the exemption outweighs the public interest in disclosure.

The financial value for this contract is based on a budget of £225,000 per annum and the award of the contract will be within the approved budget. Each commission will be funded by capital spend allocated to each scheme.

Alternative options considered

1. Deliver CDM Principal Designer and CDM Advisory services, along with Building Regulations (Principal Designer / Principal Designer Advisor) services, in-house. The Council currently lacks personnel with the required professional qualifications to provide these services, which would negatively impact the delivery of the Capital Programme

2. Tendering for CDM Principal Designer/CDM Advisory Services and Building Regulations (Principal Designer / Principal Designer Advisor) Services for each commission would require additional time and staff resources to manage the procurement process, potentially delaying project delivery.
