Purpose

To agree contracting out of provisions of the
Housing Act where required.

Content

The Executive RESOLVED

That  (i)    the Council is authorised to contract
out functions relating to reviews of homelessness decisions under
sections 202 and 204 of the Housing Act 1996 (as
amended);

         
(ii)   the appointment of an agent
to fulfil the Council’s obligations to carry out a fresh
review for a specific homelessness decision under section 202 of
the Housing Act 1996 (as amended) be approved; and

         
(iii)  the Strategic Director of
Communities be delegated authority to appoint an agent to fulfil
the Council’s obligation to review homelessness decisions
under sections 202 and 204 of the Housing Act 1996 (as amended)
when required.

Reason:   To ensure
that the Council can fulfil its legal obligations under section 202
and 204 of the Housing Act 1996 (as amended) in a timely and
impartial manner.
