Content: Salford City Council - Record of Decision   I, Councillor Mike McCusker, Lead Member for Planning, Transport and Sustainable Development, in exercise of the powers contained within the Council Constitution, do hereby approve:   The expenditure of £170,184.66 of Section 106 contributions towards delivery of public realm improvements within the Greengate Regeneration Strategy area.   The reasons are: to meet the requirement of the relevant Section 106 Agreement detailed within the report.   Options considered and rejected: Not applicable as the Section 106 Agreement detailed within the report requires expenditure on specific individual projects or types of projects.   Assessment of risk: Low – The delivery of the access and infrastructure improvement works will satisfy the terms of the Section 106 agreement.   The source of funding is: Section 106 contributions of £170,184.66 which have been received from the development located at: §  Embankment 100/101  (Section 106 Ref: 310A - 16/68132/FUL).   Legal Advice obtained: Shared Legal Service, 21.02.2025 Section 106 contributions can only be expended in accordance with the terms of the planning obligations outlined in the relevant Agreement. If the Council cannot demonstrate that the contribution has been expended in accordance with the agreements, there is a risk that the contribution may need to be repaid to the developers.  This report explains why officers are of the view that the expenditure set out herein would be in line with the terms of the Agreement.   Financial Advice obtained: Adam Mozley, Senior Trainee Accountant, 06.02.2025 The £170,184.66 Section 106 funding as identified in the report is to be allocated towards public realm improvements within the Greengate Regeneration Strategy area. The money will be used for the delivery of public realm improvements in the northern area of the Greengate Regeneration Strategy area, including public realm improvements on the corner of Greengate and Bankside Boulevard; between Trinity Way and Greengate on either side of Anaconda Cut; and along the pedestrian route connecting Greengate to the River Irwell Park. The funding as identified in the report has been received and are available to fund the works.   Procurement Advice obtained: Not applicable   HR Advice obtained: N/A   Climate Change Implications: Supplied in consultation with Mike Hemingway Climate change implications are considered through the planning application process, and where relevant appropriate mitigation will be identified through planning conditions and/or planning obligations. The Section 106 contribution(s) can only be used towards specific mitigation in accordance with the respective Section 106 agreement. The project will connect Greengate’s public realm to the Irwell River Park and Salford’s wider green infrastructure network. Navigable, attractive public realm connecting these areas will encourage active travel thereby reducing reliance on the private car.
