Content: Application for a Premises Licence – Glassbox, 18 Sidworth Street London E8 3SD The decision of 21st January 2025 The Licensing Sub-Committee in considering this decision from the information presented to it within the report and at the hearing has determined that having regard to the promotion of all the licensing objectives: · The prevention of crime and disorder; · Public safety; · Prevention of public nuisance; and · The protection of children from harm, the application for a premises licence, has been approved in accordance with the Council’s Statement of Licensing Policy, and conditions as set out in paragraph 8.1 of the report: · The hours for licensable activities Late Night Refreshment Monday 23:00-00:00 Tuesday 23:00-00:00 Wednesday 23:00-00:00 Thursday 23:00-00:00 Friday 23:00-01:00 Saturday 23:00-01:00 Sunday 23:00-00:00 Supply of Alcohol (on and off the premises) Monday 11:00-23:00 Tuesday 11:00-23:00 Wednesday 11:00-23:00 Thursday 11:00-23:00 Friday 11:00-23:00 Saturday 11:00-23:00 Sunday 11:00-22:30 The Opening hours of the premises Monday 11:00-00:00 Tuesday 11:00-00:00 Wednesday 11:00-00:00 Thursday 11:00-00:00 Friday 11:00-01:00 Saturday 11:00-01:00 Sunday 11:00-00:00 And the following conditions to be added to the premises licence: · All tables and chairs outside the premises to be brought in at 21:00 each day. · The supply of alcohol for consumption on the premises shall be ancillary to the sale of food. · Any alcohol sold or supplied for consumption off the premises shall be in sealed containers. · A contact telephone number and email address must be available to all local residents and the Environmental Protection Officers and other Responsible Authorities, including on the website of the premises, and on display at the premises. · All windows and doors shall be closed from 22:00 hours each day. And the following conditions agreed with the Police to be added to the premises licence: 1) The premises shall maintain a comprehensive CCTV system as per the minimum requirements of a Metropolitan Police Crime Prevention Officer. All public areas, entry and exit points will be covered enabling frontal identification of every person entering in any light condition. The CCTV system shall continually record whilst the premises is open for licensable activities and during all times when customers remain on the premises. All recordings shall be stored for a minimum period of 31 days with date and time stamping. 2) There will be a staff member at the premises who will be able to facilitate viewing and downloading of the CCTV system with the minimum of delay. 3) An incident log shall be kept at the premises, and made available immediately to an authorised officer of the Hackney Borough Council or the Police, which will record the following: - all crimes reported to the venue - any complaints received - any incidents of disorder - any faults in the CCTV system that you have been made aware of - any refusal of the sale of alcohol - any visit by a relevant authority or emergency service. 4) There shall be clear and prominent signage asking all customers to leave quietly and respect local residents. 5) The Premises Licence Holder shall submit a Delivery Management Plan to the Licensing Authority and Police for approval detailing procedures for the waiting and collection of orders by delivery drivers/ riders. 6) The Premises Licence Holder will provide a written dispersal policy in agreement with the Police and Licensing Authority. 7) Staff will make regular checks of the area immediately outside the premises and remove any litter emanating from the premises. 8) Only deliveries are permitted after 23:00 on Monday to Sunday. Reasons for the decision The application for a premises licence has been approved as the Licensing Sub-committee was satisfied that the licensing objectives would not be undermined. The Sub-committee took into account that Representations were made by the Police, the Licensing Authority and Other Persons (local residents). The Applicant made representations that 70% of their sales came from deliveries and did not intend to operate as a bar. The Licensing Authority made representations that the hours are beyond core hours and the conditions were agreed with the Police but the hours were not agreed with the Licensing Authority. The Licensing Authority made representations that the late night deliveries had an impact on local residents due to drivers and motorbikes frequenting the area for late night deliveries. The Sub-committee took into consideration that alcohol sales will only be with food. The Sub-committee took into consideration that it was a quiet area where the Applicant was proposing to have late night deliveries using vehicles. The Sub-committee noted that there were 4 to 5 tables for eight people outside of the premises that need to be brought inside before 21:00. The Other Persons (local residents) reside opposite the building and they were concerned about the late night opening of the premises and the impact on the area. The Applicant agreed to provide contact details to be on display at the premises. Should any local residents or responsible authorities have complaints. The Applicant agreed to provide a Delivery Management Plan to the Licensing Authority and the Police. The Sub-committee felt that the Applicant was not prepared for the late night hours that they were seeking. The Applicant agreed to reduce the hours that would help reduce the negative impact. The Applicant also agreed to work with local residents The Sub-committee has granted an extension that will be compatible with the area being a quiet and a residential area. The additional conditions agreed with the Applicant gave the Sub-committee some reassurances. The Sub-committee noted that the Other Persons welcomed the compromise on the reduced hours. The Sub-committee noted that nearby premises closed at 22:30 and there were no other late night premises in the area. The Sub-committee took into consideration that there were only online orders late at night and customers would not be on the premises or hanging around outside which would prevent noise nuisance. Having taken all of the above factors into consideration the Licensing Sub-committee was satisfied that granting the application would promote the licensing objectives. Public Informatives 1) The Premises Licence Holder is advised to utilise electric bikes as much as is practicable as part of their Delivery Management Plan to prevent public nuisance. 2) The Premises Licence Holder is encouraged to continue working with Responsible Authorities to prevent any public nuisance or negative impact in the area. 3) The Premises Licence Holder is strongly encouraged to use sustainable cutlery, plates, cups, food containers, and recyclable disposable materials to avoid using single-use plastic disposable items.
