Content: The decision of 23rd October 2024 The Licensing Sub-Committee in considering this decision from the information presented to it within the report and at the hearing has determined that having regard to the promotion of all the licensing objectives: · The prevention of crime and disorder; · Public safety; · Prevention of public nuisance; and · The protection of children from harm, The application to vary a premises licence, has been approved in accordance with the Council’s Statement of Licensing Policy, and conditions as set out in paragraph 8.1 of the report: · The hours for licensable activities Supply of Alcohol (on the premises) Monday 10:30-23:00 Tuesday 10:30-23:00 Wednesday 10:30-23:00 Thursday 10:30-23:00 Friday 10:30-00:00 Saturday 10:30-00:00 Sunday 10:30-23:00 The Opening hours of the premises Monday 07:30-23:30 Tuesday 07:30-23:30 Wednesday 07:30-23:30 Thursday 07:30-23:30 Friday 07:30-00:30 Saturday 07:30-00:30 Sunday 07:30-23:00 And the following condition to be added to the premises licence: · After 22:00 all external doors and windows shall be kept closed, other than for access and egress. Reasons for the decision The application to vary the premises licence has been approved as the Licensing Sub-Committee was satisfied that the licensing objectives would not be undermined. The Sub-Committee took into account that the Licensing Authority made representations on the grounds of public nuisance, and there were two representations from local residents also on the grounds of public nuisance, and the impact on local residents who live in close proximity to the premises. The Sub-Committee noted that there were no other representations from the other Responsible Authorities. The Sub-Committee took into consideration that the premises have a small capacity, and they currently open from Thursday to Saturday. The premises have internal seating only. There is no use of the external area. The Sub-Committee noted that the Premises Licence Holder needed to apply for planning permission. The Sub-Committee noted that there were no recent complaints. The operation of the premises under the core hours (Policy LP3) had gone some way to elevate the concerns about the hours. The Sub-Committee felt that the Applicant was willing to work with the Responsible Authorities to prevent public nuisance and to operate the premises responsibly. The Sub-Committee took into consideration that the Premises Licence Holder is an experienced operator of over 16 years. The Sub-Committee noted that the premises intend to have a jazz night from 20:00 to 22:00 in the evening and they will ensure that windows and doors are kept closed. This event occurs once every few months during the normal opening hours. The Sub-Committee felt reassured that the Premises Licence Holder agreed to a condition to keep the windows and doors closed after 22:00. The Sub-Committee took into account that regulated entertainment will only operate until 23:00, and outside of the regulated entertainment there will be ambient background music. The Sub-Committee noted the following conditions on the existing premises licence will help to maintain the licensing objectives: Condition 24 states that: “All customers shall be seated with no vertical drinking” on the premises. Condition 25 requires the Premises Licence Holder to provide contact details to local residents and the Responsible Authorities who may wish to make a complaint about the premises. Condition 27 of the premises licence stated that background music will be played outside of regulated entertainment. The Sub-Committee felt that the premises were well run and that the Premises Licence Holder demonstrated that they will consult with their neighbours regarding any issues with the premises. The Sub-Committee took into consideration that the Licensing Authority accepted the reduced hours. Having taken all of the above factors into consideration the Sub-Committee was satisfied that by granting this application would continue to promote the licensing objectives. Public Informative 1. The Premises Licence Holder is further reminded of the need to operate the premises according to any current planning permission and consents relating to its use class, conditions and to regularise the hours as required. 2. It also should be noted for the public record that the local planning authority should draw no inference or be bound by this decision with regard to any future planning application which may be made. 3. The Premises Licence Holder is encouraged to work with local residents and the Responsible Authorities to prevent any public nuisance or negative impact in the area. 4. The Premises Licence Holder is encouraged to continue working with Responsible Authorities to prevent any public nuisance or negative impact in the area.
