Content: Salford City Council - Record of Decision   I, Councillor Mike McCusker, Lead Member for Planning, Transport &  and Sustainable Development, in exercise of the powers contained within the Council Constitution, do hereby approve:   The expenditure of £208,373.20  of Section 106 contributions towards delivering a traffic calming / road safety scheme on Hilton Lane.   The reasons are: to meet the requirement of the relevant Section 106 Agreement detailed within the report.   Options considered and rejected:  Not applicable as the Section 106 Agreement detailed within the report requires expenditure on specific individual projects or types of projects.   Assessment of risk: Low – The delivery of these highways improvements will satisfy the terms of the Section 106 agreement.   The source of funding is: Section 106 contributions of £208,373.20  which have been received from the developments located at:   §  Hilton Lane (Section 106 Ref: 404 - 19/73971/FUL);   Legal Advice obtained:Supplied by Robert Irvine, Shared Legal Service, 28 February 2025 Section 106 contributions can only be expended in accordance with the terms of the planning obligations outlined in the relevant Agreement.   If the Council cannot demonstrate that the contribution has been expended in accordance with the Agreement, there is a risk that the contribution may need to be repaid to the developers.  The accompanying report explains why officers are of the view that the expenditure set out herein would be in line with the terms of the Agreement.   Financial Advice obtained: Supplied by Adam Mozley, Senior Trainee Accountant 13.02.2025 The £208,373.20  Section 106 funding as identified in the report has been received and is available to fund the works.   Procurement Advice obtained: Not applicable   The following documents have been used to assist the decision process:   §  Section 106 Agreement, Ref: 404 - 19/73971/FUL   Contact Officer:Fiona Fryer                         Tel No 779 6044     This decision is not subject to consideration by another Lead Member.   The appropriate scrutiny panel to call-in the decision is the Growth and Prosperity Scrutiny Panel.       Signed: Councillor Mike McCusker                                        Dated: 9 April 2025 Lead Member for Planning, Transport & Sustainable Development     This decision was published on 11th April 2025.   This decision will come into force at 4.00 p.m. on 22nd April 2025, unless it is called-in in accordance with the decision-making process rules.
