Amend condition 30 to read as follows: · “Alcohol shall not be sold or supplied for consumption off the premises after 23:00 on weekdays or 22:30 on Sundays and any sale of alcohol for consumption off premises shall be in sealed containers”. And the following condition will be added to the premises licence: · All licensable activities to cease 15 minutes before the terminal hour except on Fridays and Saturdays when licensable activities will cease 30 minutes before the terminal hour. Reasons for the decision The application for a premises licence has been approved as members of the Licensing Sub-Committee were satisfied that the licensing objectives would not be undermined. The Sub-Committee took into consideration that there were representations from the Police and the Licensing Authority on the grounds of public nuisance. The Sub-Committee noted that the Applicant agreed to amend condition 30 with the Health Authority. Also, there were no representations from other Responsible Authorities and no representations from local residents. The Sub-Committee took into consideration the representations from the Applicant’s legal representative that there was no primary evidence of noise nuisance from patrons or residents. The premises have not added to the noise or negative impact in the area. The Applicant has shown that they can operate temporary events until 04:00 without cause and concern for over 10 years. The Applicant has been proactive in working with the Police, and has operated the premises responsibly. Also, the tube station is close to the premises and hours correspond with the tube times. The Sub-Committee took into consideration the representations from the Police that their concerns related to the negative impact in an area with a number of venues. The premises is in a pedestrian area and hotspot for late night venues dispersing. The Police also had concerns about vulnerable females late at night. The Police made representations that later dispersal will result in people being outside the premises later at night. The Sub-Committee took into consideration the representations from the Licensing Authority that their concerns relating to the negative impact of operating beyond core hours, and the non-standard hours. The Sub-Committee decided to grant the premises license because they felt that the Applicant demonstrated that they were willing to work with the Police to prevent public nuisance, and they were satisfied that the Applicant would not undermine the licensing objectives. The Sub-Committee noted that the premises has staff monitoring customers, the toilets and monitoring the premises area to ensure safety for their customers. The Sub-Committee felt that the Applicant was prepared to compromise on the operating hours. The Sub-Committee took into consideration that the premises have had a number of temporary event notices without incident. The Applicant has demonstrated that the premises can operate responsibly, and have a staggered dispersal of customers. The Sub-Committee noted that the premises are accredited with Hackney Nights. Having taken all of the above factors into consideration the Sub-Committee was satisfied that by granting the premises licence the licensing objectives would not be undermined.
