Purpose: To renew and / or extend the following PSPOs: Southend Town Centre PSPO Leigh PSPO Car Cruise PSPO Dog Control PSPO Southend Seafront and adjoining areas PSPO

Content: The Cabinet considered a report of the Executive Director (Environment and Place) presenting the 5 current Public Spaces Protection Orders (listed below) for renewal, taking into consideration the results of the statutory consultation and further evidence.   Southend Town Centre PSPO Leigh PSPO Car Cruise PSPO Dog Control PSPO Southend Seafront and adjoining areas PSPO   Resolved:   1. That the renewal and variation of the Public Spaces Protection Order (Southend City Centre, Seafront and Adjoining Areas) No 2 of 2022 (“the 2022 PSPO”), as set out at Appendix 1 to the submitted report, be approved and the PSPO area be extended to include London Road, Westcliff from the junction with West Road through to the junction with North Road/Milton Road due to displacement from Hamlet Court Road.   2. That the early renewal of the Public Spaces Protection Order (Leigh-on-Sea and Chalkwell Seafront and Adjoining Areas) No 2 of 2024 (“the 2024 PSPO”), as set out at Appendix 2 to the report, so that it coincides with the renewal cycle of the other Southend-on-Sea City Council PSPOs, be approved.   3. That the early renewal of the Public Spaces Protection Order (Car Cruise) No 1 of 2023 (“the 2023 PSPO”), as set out at Appendix 3 to the report, so that it coincides with the renewal cycle of the other Southend City Council PSPOs, be approved.   4. That the early renewal of the Southend-on-Sea City Council (Dog Control) Public Spaces Protection Order No 1 of 2024 (“the 2024 PSPO”), as set out at Appendix 4 to the report, so that it coincides with the renewal cycle of the other Southend City Council PSPOs, be approved.   5. That the renewal of the Southend-on-Sea City Council (Southend Seafront and Adjoining Areas) No 3 Public Spaces Protection Order of 2022 (“the 2022 PSPO”), as set out at Appendix 5 to the report, be approved.   Reasons for decisions:   1. To align the PSPO renewal cycles to reduce unnecessary duplication and repeated administration.   2. The renewal will enable the continued and necessary control of relevant matters relating to anti-social behaviour and the ability for officers to issue Fixed Penalty Notices where breaches of the Order are witnessed and those responsible are identified.   Other options:   1. Not to renew the current PSPOs. This would result in the current PSPOs expiring at their individual expiry dates, and the associated enforcement powers would no longer be available to Essex Police and the Council’s authorised officers for tackling ASB in the restricted areas.   2. To renew the 5 separate PSPOs individually. This would result in at least one PSPO being renewed each year with the associated administration and burden on Officer time.   Note: This is an Executive Function Not eligible for call-in Cabinet Member: Cllr Terry
