Content: The decision The Licensing Sub-Committee, in considering this decision from the information presented to them within the report and at the hearing and having regard to the promotion of the licensing objectives: · The prevention of crime and disorder · Public safety · Prevention of public nuisance · The protection of children from harm The application for a premises licence has been approved in accordance with the Council’s Statement of Licensing and the proposed conditions set out in paragraph 8.1 of the report. The hours of licensable activity Supply of Alcohol (Off the Premises) Monday - Sunday 09:00 - 23:00 Opening hours Monday - Sunday 09:00 - 23:00 Reasons for the decision The application for a premises licence has been approved as members of the Licensing Sub-Committee were satisfied that the licensing objectives would not be undermined in the Shoreditch Special Policy Area (Shoreditch SPA). The Sub-Committee took into consideration that this is an application which involves the change of the layout of the premises from a cocktail bar to an off-licence. The Sub-Committee heard representations from the Applicant’s legal representative that the existing premises will not add to the cumulative impact of the area. In addition, the Applicant’s legal representative contended there is no evidence in the original application to show that the premises will add to the cumulative impact in the area. The Applicant’s legal representative made representations that the conditions on the license were robust, and dealt with the strength of alcohol. The Sub-Committee noted that no other persons or local residents made representations against the application. The Sub-Committee took into consideration that the Police made representations objecting to the application because there were already 14 off-licences in the area, and an additional off-licence will add to anti-social behaviour, and crime and disorder that will impact local residents in the Shoreditch SPA. The Sub-Committee took into account Police concerns about customers pre and post loading which would be harder to manage as they cannot assess easily how much the customers have been drinking. The Sub-Committee took into consideration that the Police had provided evidence to demonstrate how the area was negatively affected by existing off-licences in the area. The Sub-Committee heard representations from the Licensing Authority that the off-licence will have an increased impact on street drinking, pre-and post-drinking, which will not be acceptable under Policy LP1 to go beyond the Policy hours under LP3 and LP4 for off-sales. The Licensing Authority made representations that it was not appropriate to add another licensed premises in this already saturated area that has a number of off-licences, and where people do not disperse easily. The Sub-Committee felt that the Applicant did not present any mitigating factors for operating beyond the Policy hours, and the Applicant did not demonstrate that they will not add to the cumulative impact in the area. The Sub-Committee felt the hours applied for were excessive and would have a negative impact on the area. Therefore, it was appropriate to limit the hours to Policy LP4 consistent with other off-licences to prevent public nuisance, anti-social behaviour, and crime and disorder. The Sub-Committee took into consideration the Police and the Licensing Authority did not support the application, and they presented a compelling case regarding the negative impact that an additional off-licence would have on the area Having taken all of the above factors into consideration the Sub-Committee was satisfied that by granting the premises licence the licensing objectives would not be undermined in the Shoreditch SPA. Public Informative The Premises Licence Holder will surrender their existing premises licence.
