The hours for licensable activities, shall be, as agreed:   Late Night Refreshment   Monday - Thursday 23:00 - 00:00 Friday - Saturday  23:00 - 01:00 Sunday    23:00 - 23:30   Supply of Alcohol (on sales)   Monday - Thursday 11:00 - 00:00 Friday - Saturday  11:00 - 01:00 Sunday    10:00 - 23:30   Opening Hours of the premises   Monday - Thursday 08:00 - 00:30 Friday - Saturday  08:00 - 01:30 Sunday    08:00 - 00:00   Reasons for the decision   The application to vary this premises licence has been approved, as members of the Licensing Sub-Committee were satisfied that the licensing objectives would not be undermined.   The Sub-Committee took into consideration the Licensing Authority made representations on the grounds of the prevention of public nuisance.   The Sub-Committee noted that the Police and the Environmental Enforcement Service withdrew their representations after agreeing conditions with the Premises Licence Holder. The Sub-Committee noted there were no objections received from local residents.   The Sub-Committee heard representations from the Premises Licence Holder’s agent that they had agreed conditions to mitigate the risk. The premises are already open late. The proposed hours will not be out of character for the area as there are other premises with similar hours.   The Sub-Committee took into consideration the Premises Licence Holder made representations that SIA and fully trained staff are at the premises. Alcohol is only served with table meals, and there is no takeaway. They have clear signage and the Premises Licence Holder made representations that they would be prepared to reduce the hours by one hour.   The Sub-Committee took into account the representations made by the Licensing Authority that the hours sought go beyond the core hours and are excessive. The residential properties are close to the premises and local residents will be disturbed. The Licensing Authority made representations of the hours to be reduced to core hours.   The Sub-Committee were concerned about local residents being affected by the Thursday late night opening. The Sub-Committee felt after considering all the representations that they could not extend the hours and they needed to consider the impact on the area. The Sub-Committee felt local residents are affected on Thursdays because this is still part of the working week when late night hours would be a concern.   The Sub-Committee felt in terms of public nuisance there were concerns with the hours after midnight that will result in issues occurring and adds to the potential disturbance to local residents.   Having taken all of the above factors into consideration the Sub-Committee was satisfied that by granting this variation of the premises licence, the licensing objectives would continue to be promoted.   Public Informative   The Premises Licence Holder is encouraged to work with local residents and be proactive with resident engagement to prevent any public nuisance or negative impact in the area.
