Purpose:
Content: The Township Committee considered a report of the Director of Economy and Place, which sought approval of a map modification order to upgrade the footpaths stated within the report, to bridleway and to add a bridleway to the definitive map and statement running from Wicken Hall Farm/House to an existing restricted byway (RUPP) MilRupp25 made under the Wildlife and Countryside Act 1981 and carried out under The Highways Act 1980. The Rights of Way Officer was in attendance to present the report and to address the questions and the comments of the Committee Members. Having listened to the Officer’s presentation, Members agreed in principle with the action outlined within the report and required further consultation with Ward Councillors and an additional sight visit. Resolved that the decision be delegated to the Head of Township and Communities, in consultation with the Chair and Vice-Chair of the Township and subject to an additional site visit and consultation with Ward Councillors. Reason for decision: Additional consultation with Ward Councillors and an additional site visit would be necessary before making a decision. Alternatives considered and rejected: The only alternative would be to decline to make the order. This would mean the Council are in breach of its duty and it would entitle the applicant to appeal to the Secretary of State under paragraph 4 of Schedule 14 of the Wildlife and Countryside Act 1981. There are no alternatives for the Council to consider we have received an application to process based on evidence of use and landowner representation as guided by relevant rights of way legislation.
