Content:  DECISION NOTICE 1. Supercharger Central Limited (“the Applicant”) applied for a new Premises Licence on 29th July 2025 for KFC Catford, 158 Rushey Green, London SE6 4HQ (“the Premises”). 2. The application was advertised in accordance with Regulation 25 of the Licensing Act 2003 (Premises licences and club premises certificates) Regulations 2005,and the last date for representations was 26th August 2025. 3. The particulars proposed for the premise licence were: Particulars of Application Late Night Refreshment 23:00 – 00:00 Monday to Sunday 4. Two representations were received from local Councillors, James Walsh and John Muldoon, on the grounds that the application does not promote the Licensing Objectives of the prevention of public nuisance and the prevention of crime and disorder. The representations were received within the specified time, were examined by Officers and were not considered to be vexatious or frivolous. 5. The Applicant offered conditions as part of the application, appearing in Section M of the form. These are to be found in the Agenda in section 9.4 on pages 76 to 77 inclusive. There were no representations received from any Responsible Authority. 6. Correspondence between the Applicant and the two Councillor objectors, including a Driver/ Rider Management Policy was the subject of an eight-page Supplementary Agenda, which was circulated to the participants. 7. In the afternoon of the 2nd October 2025 a document entitled ‘KFC suggested conditions from Cllr Walsh with comments from the Applicant’s representative’ was circulated to members of the sub-Committee and Cllr Walsh. It sets out the conditions that the Applicant is willing to agree and also those it does not agree giving the reasons for this. 7. The Licensing Sub- Committee C held a meeting on the 2nd of October 2025 to consider the Application. Safer Communities, Licensing Officer, Angela Mullin-Murrell, introduced the report. Chris Rees Gay of Woods Whur, for the Applicant addressed the Committee in support of the premises licence application with Sean Lewisham Regional Manager for KFC Catford also present. They were allowed a fixed period of time and then answered Members’ questions. Both of the local Councillors who had submitted written representations objecting to the grant of the licence, attended, only Cllr James Walsh, spoke at the meeting. He was allowed an equal amount of time and answered the questions put to him by Members. The Applicant’s solicitor was given an opportunity at the end to briefly sum up and then the objecting Councillor was given the same opportunity. 8. In making its decision the Sub-Committee has considered all the papers contained in the report pack and submitted documents, including written submissions, together with the oral submissions presented by the Applicant’s solicitor and the Councillor objector at the hearing. The Sub-Committee also considered the Council’s own Statement of Licensing Policy 2020-25 and the latest Home Office Statutory Guidance, revised in December 2023. 9. The decision of the Sub-Committee is to grant the Premises Licence for late night refreshment for the hours requested, subject to the conditions offered with the Application and the additional conditions agreed by the Applicant (See ‘KFC Catford, 158 Rushey Green - Conditions Agreed by Applicant’ enclosed). 10. The Sub-Committee’s reasons for taking this decision are: a. The Sub-Committee noted that the conditions offered with the Application together with the additional conditions agreed by the operator were appropriate and necessary to promote the licencing objectives. No further conditions were required. b. The Sub-Committee noted that on the Premises becoming operational, if the licence conditions were not complied with it was open for any person to instigate the licence review process. 11. There is a right of appeal against this decision. Any appeal should be made to the Magistrates’ court within 21 days beginning with the day on which the Appellant was notified of the decision. Any person who has given notice of appeal on a licensing decision to the Magistrates Court, or is considering doing so, should not approach council officers for legal advice. A person making an appeal should seek independent legal advice, for instance, from a firm of solicitors or the local Citizens Advice Bureau may be able to assist. 2nd October 2025   KFC Catford, 158 Rushey Green – Conditions Agreed by Applicant Set out below are the Licence Conditions that Supercharger have agreed, including those conditions offered in the original application: 1. A CCTV system shall be installed, recording and maintained in working order and operated at the premises to the satisfaction of Metropolitan Police, specifically: a) There shall be a minimum of one high resolution colour camera, fitted in a weatherproof housing, for external coverage of the entrance. b) There shall be a minimum of one high-resolution colour camera fitted to each public entrance/exit. To provide a quality head and shoulder image for facial recognition/identification purposes of all persons entering the premises. c) There shall be sufficient cameras able to cope with the normal operating illumination to reasonably cover all licensed public areas. d) Recordings must be kept for a minimum of 31 days and endorsed with the accurate, correct time/date (BST/GMT adjusted). e) Police and/or Authorised Licensing Officers shall be able on attendance to view immediate playback of any incident without the necessity for download. f) Recordings of incidents at the premises must be provided to the police following lawful request. g) A member of staff shall be on the premises at all times they are open to the public who is capable of operating the CCTV system and providing recordings on request. When this is not possible recordings shall be provided within 24 hours of the original request. h) Recording equipment shall be housed in a secure room/cabinet where access and operation is strictly limited to authorised persons. i) All equipment shall have constant time/date generation, which must be checked for accuracy on a daily basis. j) The CCTV system should be maintained and checked every 12 months, with the installing company, or if this is not possible another reputable company, producing a letter of compliance. k) In the event of a system malfunction, the Premises Licence Holder must immediately record details of this malfunction in the premises incident book. Arrangements for its repair must be made without delay. 2. An incident book shall be kept at the premises, in which details of crime and/or disorder relating to the premises shall be recorded. The Incident book shall contain the following details; a) Time, date and location of incident. b) Nature of the Incident. c) Names, addresses and contact details of persons involved. d) Result of the incident. e) Action taken to prevent further such incidents. f) Each entry signed by a responsible person employed at the premises. g) The incident book shall be retained for a period of no less than 12 months and made available to Lincolnshire Police for inspection upon request. 3. Members of the public will be prevented from accessing hot food and preparation areas to prevent risk of scald or burns. 4. Licensable activities will be conducted and the facilities for licensable activities will be designed and operated so as to prevent the transmission of audible noise or perceptible vibration throughout the fabric of the building or structure to adjoining properties. 5. No deliveries to the premises shall take place between the hours of 23:00 and 07:00 the following morning. 6. No waste collections from the premises shall take place between the hours of 23:00 and 07:00 the following morning. 7. . The premises licence holder shall operate and maintain a written Delivery Driver Management Policy covering directly employed drivers and third-party couriers (e.g. UberEats, Deliveroo, JustEat). The policy shall be reviewed annually or sooner if requested in writing by the Licensing Authority. 8. Delivery drivers shall be directed to use only designated loading bays or other lawful parking provision, and not to park on the pavement or public realm. 9. Installation of clear signage instructing drivers to not park mopeds, loiter or congregate on the pavement around the premises and respect the local community. 10. Every hour during the hours of operation of the premises and at close, the licence holder shall ensure a litter pick is undertaken to remove and prevent litter or waste arising or accumulating from customers in, but not limited to, the area immediately outside the premises and along the side around their bins. 11. All commercial waste to be stored in secure, lidded, pest-proof containers. 2nd October 2025
