Purpose:
Content: 1. Fresh from Yard Ltd (“the Applicant”) applied for a new Premises Licence on 20th August 2025 for Fresh from Yard Ltd, 29 Catford Broadway, Catford, London SE6 4SN (“the Premises”). 2. The application was made and advertised by owner Kenrick Slowley for his business. To ensure the application was advertised in accordance with Regulation 25 of the Licensing Act 2003 (Premises licences and club premises certificates) Regulations 2005, and the last date for representations was 25th September 2025. 3. The particulars proposed for the premise licence were: Particulars of Application Sale of alcohol for consumption OFF the premises. 08:00 – 20:00 Monday to Saturday 09:00 – 17:00 Sunday 4. A representation was received from a local Councillor on the grounds that the application does not promote the Licensing Objectives, of the prevention of public nuisance and the prevention of crime and disorder. The representations were received within the specified time, were examined by Officers and were not considered to be vexatious or frivolous. 5. The Applicant offered conditions as part of the application, appearing in Section M of the application form. Representations were received from the Police but following an agreement with the applicant to include additional conditions, the Police withdrew their objections. These additional conditions can be found at 9.3, on pages 76 to 77 in the Agenda. No other Responsible Authority made any representations. 6. The Licensing Sub-Committee D held a meeting on the 14th of October 2025 to consider the Application. Safer Communities, Senior Licensing Officer, Richard Lockett, introduced the report. The owner of the applicant company, Kenrick Slowley, then addressed the Sub-Committee in support of the premises licence application. He was allowed a fixed period of time and answered Members’ questions. The local Councillor, who submitted written representations objecting to the grant of the licence, attended and was invited to speak at the meeting. He was allowed an equal amount of time and answered the questions put to him by Members. The Applicant was given an opportunity at the end to briefly sum up, as was the Councillor. 7. In making its decision the Sub-Committee has considered all the papers contained in the report pack and submitted documents, including written submissions, together with the Applicant’s oral submissions and the Councillor objector at the hearing. The Sub-Committee also considered the Council’s own Statement of Licensing Policy 2020-25 and the latest Home Office Statutory Guidance, revised in December 2023. 8. The decision of the Sub-Committee is to grant the premises licence for the sale of alcohol for consumption off the premises, a. With hours modified as follows: Sale of alcohol for consumption OFF the premises. 10:00 – 20:00 Monday to Saturday 10:00 – 17:00 Sunday b. And otherwise in accordance with the offered conditions and additional conditions agreed by the applicant with the Police and with the following further conditions: i. Spirits restriction (small bottles) No spirits shall be sold in containers of 500ml or below. ii. Street drinking / PSPO safeguards Prominent signage shall be displayed at points of sale and exit stating that the premises is within a PSPO zone prohibiting street drinking. Such signage shall be at least A4 size, with wording to the satisfaction of the Licensing Authority 9. The Sub-Committee’s reasons for taking this decision are: a. The Sub-Committee recognised there was a problem with street drinking in the centre of Catford, including Catford Broadway, which is subject to a Public Spaces Protection Order (‘PSPO’) that includes a prohibition against the consumption of alcohol so as to cause nuisance and annoyance to other people. b. The Sub-Committee considered that permitting sales of alcohol from 8.00am would tend to encourage early-morning street drinking and a later start time of 10.00am would be more appropriate; sale of spirits in miniatures and quarter bottles tended to facilitate quick intoxication; it was appropriate to remind those purchasing alcohol for consumption off the premises that they were in a PSPO zone that restricted street drinking. The modified hours of operation and the two additional conditions were necessary and proportionate to promote the licensing objectives. c. The Sub-Committee noted that on the Premises becoming operational, if the licence conditions were not complied with it was open for any person to instigate the licence review process. 11. There is a right of appeal against this decision. Any appeal should be made to the Magistrates’ court within 21 days beginning with the day on which the Appellant was notified of the decision. Any person who has given notice of appeal on a licensing decision to the Magistrates Court, or is considering doing so, should not approach council officers for legal advice. A person making an appeal should seek independent legal advice, for instance, from a firm of solicitors or the local Citizens Advice Bureau may be able to assist. 14th October 2025
