Content: The decision of the Committee is to grant the application subject to the conditions agreed. The Committee in reaching its decision has taken into account: · The evidence before it both written and oral · The relevant parts of the Council’s Statement of Licensing Policy · The relevant parts of the Guidance issued by the Secretary of State Committee’s reasoning and findings are: Committee noted that the application before it relates to a premises that operated as a restaurant which requires total renovation. The applicant Company through Mr and Mrs Bhimereddy will be investing a considerable amount of money in renovating the premises and Mr Rajesh explained that if the application is granted the premises will not open for some time due to the amount of work required. Mr Rajesh also confirmed that Mr and Mrs Bhimereddy have worked in licensed premises previously but are not local to the Walker area. For that reason, amongst others, they had had particular regard to the views of the Responsible Authorities when submitting the application. Considerable discussions had taken place which had resulted in a schedule of conditions had been agreed which Mr Rajesh submitted were far more rigorous than those on existing premises licences for those premises in the vicinity. The conditions were explained to Members including the restrictions on types of alcohol and quantity thereof. The amendment to the hours sought brought the application within the City Council’s framework of hours as set out in the statement of licensing policy. Members noted the concerns expressed by the Interested Parties and accepted the fact that they were operators experienced in the area in which the premises are located. They considered all allegations of anti social behaviour within the area. Other than the allegations before them Committee felt that there was no other corroborating evidence in this regard. The petition that had been submitted against the application was considered and appropriate weight attached thereto. However, Members also noted the absence of any representation regarding concerns of public nuisance and crime and disorder from the Responsible Authorities. Indeed Members accepted the willingness of the Applicant to liaise with the Responsible Bodies which had resulted in a comprehensive suite of conditions being agreed. Members were aware that matters of competition and the economic viability of this application were not considerations within their remit when determining this application. In all of the circumstances, Committee unanimously decided to grant the application.
