Purpose:

Content: Decision   RESOLVED:   1.1) That the Cabinet agreed to change the leisure management agreement with InspireAll and replace this with an agency agreement. 1.2) That the Cabinet agreed that the potential tax efficiencies arising from adopting the agency model be apportioned between the Council and InspireAll as described in Section 6. 1.3) That the Cabinet delegated authority to the Assistant Director Finance and the Assistant Director Legal & Democratic Services in consultation with the Cabinet Members for Finance & Budget and for Street Scene Parks, Leisure & Culture to finalise negotiations with InspireAll and complete all legal documents to implement the new arrangement as soon as possible.   Subject to the approval of the confidential information set out in the appendix at agenda item 11.1   Reasons for decision   Cabinet approval was sought to agree that the Council change their existing Leisure Management agreement to a more tax efficient “Agency Model Cabinet delegation was also required to enable officers to proceed with the implementation of the Leisure Management “Agency Model” as explained in this report.   Alternative Options Considered   The Council could have continued with the current leisure management agreement and forgo the potential tax efficiencies.   If the agency model was agreed the Council could decide to negotiate and alternate apportionment of the potential tax efficiencies to the 50:50 apportionment that was proposed.
