Purpose: The report recommends that the Cabinet approves the confirmation of an Article 4 Direction to remove the permitted development rights to change use from Class E (commercial, business or service) to C3 (residential) on protected employment sites within the Borough following public consultation. The Council made a non-immediate Article 4 direction on 18th January 2024, as agreed by Cabinet on 13 December 2023 (Agenda item 12 Minute refers), that would remove certain permitted development rights that would result in new residential dwellings covering protected employment sites set out in BLP Policy ED2. Subject to the Council confirming the direction, and there being no intervention by the Secretary of State, it would come into force on 30 January 2025. This report recommends confirming the direction.

Content: AGREED: That Cabinet noted the report and: i)                 Agreed the responses to the representations to the consultation on the Article 4 Direction, set out in Appendix C; ii)               Delegated authority to the Assistant Director of Planning in consultation with the Cabinet Member for Planning, Governance & Asset Management, to approve and publish any minor changes to the consultation statement, prior to its publication; iii)             Agreed to confirm the non-immediate Article 4 Direction made on 18 January 2024 covering the area shown in Appendix B to remove the following permitted development rights within Schedule 2 of the General Permitted Development Order 2015 (as amended): - Part 3 class MA
