Content: There had been circulated a report dated 23 August 2024 by the Director of Environment and Infrastructure Services, requesting Members’ consideration of an application for Full Planning Permission for Alterations, Extension and Change of Use of Boat House to Form Dwellinghouse at The Boat Shed, Shore Street, Pennan, Aberdeenshire, recommended for approval as in compliance with Aberdeenshire Local Development Plan.     The Committee were advised that a request to speak had been made by Mr. Ritchie, Agent, on behalf of the applicant, and agreed to hear Mr. Ritchie.   Members heard from Mr. Martin, Senior Planner,     Questions were asked of officers     There being no further questions for officers, the Committee heard from Mr. Ritchie   Questions were asked of Mr. Ritchie   There being no further questions, Mr. Ritchie confirmed that he had had a fair hearing.     Members confirmed they had sufficient information to determine the application.   There was discussion of     Councillor     moved, seconded by Councillor                  Councillor      moved, as an amendment, seconded by Councillor        On a division, there voted   For the Motion         (         )         Councilllors   For the Amendment           (         )         Councillors Absent from the Division/   (         )         Councillors Declined to Vote                (         )         Councillors   The    was therefore carried and the Committee agreed to:   10.1 GRANT Full Planning Permission, subject to the following conditions:- 01. In accordance with Section 58 of the Town and Country Planning (Scotland) Act 1997 (as amended) this planning permission will lapse on the expiration of a period of three years from the date of this decision notice, unless the development is begun within that period. Reason: Pursuant to Section 58 of the Town and Country Planning (Scotland) Act 1997 (as amended).   02. The proposed development shall be connected to the public water supply as indicated in the submitted application and shall not be connected to a private water supply without the separate express grant of planning permission by the planning authority. Reason: To ensure the long term sustainability of the development and the safety and welfare of the occupants and visitors to the site. Page 28 Item 5   03. Wastewater from the proposed development shall be disposed of via the public sewer as indicated in the submitted application and shall not be disposed of via private means without the separate express grant of planning permission by the planning authority. Reason: To ensure the long term sustainability of the development and the safety and welfare of the occupants and visitors to the site.   04. The dwellinghouse hereby approved shall not be occupied unless the proposed surface water drainage system has been provided in accordance with the approved drawing 24028 02A Surface Water Drainage of 9 August 2024. The surface water drainage system shall be permanently retained thereafter.   Reason: In order to ensure that adequate drainage facilities are provided, and retained, in the interests of the amenity of the area.   10.2 Reason for Decision   The Planning Authority considers that the application is for a development that is in accordance with the National Planning Framework 4 (NPF4) and Aberdeenshire Local Development Plan (ALDP 2023). The proposal relates to the change of use of a boat house and it has been demonstrated that the change of use to a dwellinghouse can be accommodated without significant adverse impacts on the amenity of the surrounding properties or on the appearance and character of the Pennan Conservation Area. The proposal is in accordance with Policy 7 Historic assets and places, Policy 9 Brownfield, vacant and derelict land and empty buildings, Policy 14 Design, quality and place, Policy 16 Quality homes and Policy 22 Flood risk and water management of National Planning Framework 4 and Policy P1 Layout, siting and design, Policy P3 Infill Developments within Settlements and Householder Developments (including home and work proposals), Policy HE2 Protecting Historic, Cultural and Conservation Areas, Policy RD1 Providing Suitable Services, Policy P4 Hazardous and Potentially Polluting Developments and Contaminated Land and Policy RD2 Developer Obligations of the Aberdeenshire Local Development Plan 2023.
