The School Placings and Exclusions Appeals Committee of Aberdeenshire Council was scheduled to consider two placing appeals. The committee was also due to discuss its adherence to the Public Sector Equality Duty.
Public Sector Equality Duty
The committee was scheduled to consider and potentially adopt a resolution regarding its Public Sector Equality Duty. This duty, as outlined in section 149 of the Equality Act 2010, requires public bodies to have due regard to the need to eliminate discrimination, harassment, and victimisation; advance equality of opportunity between those with and without protected characteristics; and foster good relations between those with and without protected characteristics. The protected characteristics include age, disability, gender reassignment, pregnancy and maternity, race, religion or belief, sex, and sexual orientation. Members were reminded that this duty requires conscious consideration and must influence final decisions, though it is not a duty to achieve a specific outcome. The committee was also to consider the contents of any Integrated Impact Assessment (IIA) provided within reports, taking them into account when reaching decisions. An IIA is typically provided when a proposal is likely to have a differential impact on people from different protected groups.
Placing Appeal - Kemnay Primary School
The committee was scheduled to consider a placing appeal, identified as E 1033, concerning Kemnay Primary School. This item was designated as exempt from public disclosure under paragraph 5 of the relevant schedule, indicating that it involved information relating to the adoption, care, fostering, education, or supervision of a particular child.
Placing Appeal - Kellands Primary School
A second placing appeal, identified as E 1034, relating to Kellands Primary School, was also scheduled for consideration. Similar to the Kemnay Primary School appeal, this item was also exempt from public disclosure under paragraph 5, due to its nature involving sensitive information about a child's care or education.
