The committee was scheduled to review the established procedure for conducting licensing hearings. This procedure outlines the steps to be followed, including the presentation of cases by applicants and responsible authorities, questioning of witnesses, and the order of summing up. The procedure also details how decisions will be made in private and communicated to the parties involved.
Temporary Event Notice for The Nightingale
A Temporary Event Notice (TEN) was scheduled for discussion concerning an event proposed to take place at The Nightingale, located at 51 Nightingale Lane, Wanstead, London, E11 2EY. The event was planned for Saturday, 9 May 2026, from 7:00 PM to 11:30 PM, and was to feature DJ music described as live recorded music.
The report pack indicated that an objection notice had been received from the Community Protection Task Force (CPTF), acting as Environmental Health (Noise). The CPTF's objection was based on concerns that the event might undermine the licensing objective of preventing public nuisance.
The report pack outlined the potential decisions the Sub-Committee could make:
- Allow the Temporary Event to take place as notified.
- Allow the Temporary Event to take place with some or all of the existing premises licence conditions imposed.
- Issue a Counter Notice, effectively refusing the event.
The report pack detailed the requirements for a Temporary Event Notice under Section 100 of the Licensing Act 20031, which allows for events to be notified rather than requiring prior authorisation. It also referenced the council's Statement of Licensing Policy2, which provides guidance on the council's approach to TENs.
The report pack included appendices containing the TEN form, the current Premises Licence for The Nightingale, a location map, the CPTF objection notice, and an extract from the Licensing Policy concerning TENs. The report also highlighted the legal implications of the Licensing Act 2003, including the notification periods for TENs and the potential for appeals.
The report pack also contained information regarding the premises licence for The Nightingale, held by THE NIGHTINGALE PH LTD. This licence authorises the supply of alcohol and late-night refreshment, with specific hours of operation. It also detailed conditions attached following a previous Sub-Committee hearing on 14 February 2025, which included restrictions on live and recorded music, requirements for a noise limiter system, CCTV standards, and an anti-drugs policy.
A representation from the Community Protection Team, dated 18 March 2026, was also included. This representation detailed concerns about potential breaches of the premises licence conditions, specifically regarding the involvement of Daniel Sherman, a former Designated Premises Supervisor, in serving behind the bar. The representation also noted issues with the sound limiter during a previous event on 7 March 2026, which was believed to have caused a public nuisance. The representation concluded by recommending the rejection of the TEN due to these concerns and a perceived disregard for licensing objectives and conditions.
