Summary

Open Council Network is an independent organisation. We report on Waltham Forest and are not the council. About us

The Planning Committee of Waltham Forest Council met on Tuesday 01 November 2011, granting planning permission for several development applications and discussing the circulation of agenda papers. Decisions were made on applications for residential development at Headbourne House and 55 Stainforth Road, as well as for loft conversions and accessibility improvements at other locations.

Development Management Applications

The committee considered a range of planning applications, with decisions made on several individual sites.

Headbourne House, 22 Sutherland Road, Walthamstow, London E17

Outline planning permission was granted in principle for the demolition of an existing industrial building and the construction of a residential block of up to five storeys, comprising 4518.5 sq m of gross external floorspace and a basement area of 614 sq m, along with associated car parking and landscaping. This decision is subject to the applicant entering into a Section 106 Legal Agreement with the Council.

The legal agreement will include:

  • Provision of 50% affordable housing, with a mix in line with the Council's adopted Housing Strategy1 and at rents consistent with the Council's Affordable Rent Guidance. A residential provider must be agreed to deliver the required accommodation.
  • A financial contribution of £5,000 per residential unit towards the Council's S106/Tariff requirements, to be pooled and used for physical and social infrastructure to facilitate the development.
  • A financial contribution of £24,495.18 to compensate for the loss of significant trees and to enable their replacement in the vicinity of the site.
  • A financial contribution of £5,000 towards air quality monitoring.
  • An agreement with the Council as Local Highway Authority to cover the costs of alterations and improvements to the footway, any stopping up of existing accesses, or related works to the public highway.
  • A condition that the development will be permit-free, meaning future residents will not be entitled to parking permits, with the exception of Blue Badge holders, should a residents' controlled parking zone be introduced later.
  • An administration fee of 5% of the total amount for monitoring the agreement.

55 Stainforth Road, Walthamstow, London E17

Planning permission was granted in principle for the erection of a three-storey building comprising 8 flats (1 x 3-bed, 2 x 2-bed, 4 x 1-bed, and 1 x studio). This decision is also subject to the applicant entering into a Section 106 Legal Agreement.

The legal agreement for this application includes:

  • A contribution of £3,000 towards street tree planting.
  • A condition that future occupiers of the residential flats will not be entitled to obtain parking permits for surrounding Controlled Parking Zones.

46 Colworth Road, London E11

An application for a Certificate of Lawfulness was refused. The Committee was advised by the Legal Officer that they had two choices: not to approve the recommendation, which would be consistent with Department for Communities and Local Government (DCLG)2 guidance and reduce the risk of losing appeals, but would be judged as poor planning in terms of aesthetic result and inconsistent with current challenges to other decisions. Alternatively, approving the recommendation would be consistent with other DCLG guidance and ensure better aesthetic outcomes, but could increase the risk of losing appeals and incurring costs. The Committee chose to refuse the application.

48 Forest View Road, Walthamstow, London E17

Planning permission was granted for a loft conversion with a rear dormer window.

199 Leucha Road, Walthamstow, London E17

Planning permission was granted for the installation of ramped access in the front garden.

Land to the West Side of Leyton Marshes, Leyton, London E10

Planning permission was granted for the installation of a replacement footbridge over the Dagenham Brook.

Circulation of Planning Committee Agenda Papers

The Committee requested that in the future, arrangements be made to ensure that agendas for meetings are circulated to members of the committee as early as possible after publication.

  1. The Housing Strategy is a document outlining the council's plans and objectives for housing provision and improvement within the borough.

  2. The Department for Communities and Local Government (DCLG) was a ministerial department of the UK Government responsible for housing, community, and local government. It was replaced by the Ministry of Housing, Communities and Local Government in 2018.
