Mr Gwam expressed a lack of confidence that the premises could operate without causing further disturbance to nearby residents, particularly given the requested late operating hours extending to 01:30.

Ziya Merton, a licensing consultant for the applicant, argued that significant investment, exceeding £10,000, had been made in soundproofing works to address previous issues. He stated that the applicant had sought to engage with the responsible authorities and invited the Noise and Nuisance Team to inspect the completed works. Mr Merton suggested that the TENs provided an opportunity for the applicant to demonstrate the effectiveness of these improvements.

Despite the applicant's assurances and investment in soundproofing, the committee, after considering all submissions and having regard to the relevant legislation, the Secretary of State's Guidance, and the Authority's Statement of Licensing Policy, decided to issue a counter notice under section 105 of the Licensing Act 2003 for each of the four applications. This means that the licensable activities described in the TENs are not authorised and may not take place. The committee noted that the applicant or any person who made a relevant representation is entitled to appeal this decision to the magistrates' court within 21 days.
