Open Council Network is an independent organisation. We report on Aberdeenshire and are not the council. About us
The Marr Area Committee was scheduled to consider a range of matters, including a planning application for a dwellinghouse in Braemar, an asset transfer request for Lumphanan Hall, and a proposed policy on school capacity, reserved places, and admission limits. The committee was also scheduled to address the Public Sector Equality Duty and consider exempt information.
Planning Application for Dwellinghouse in Braemar
The committee was scheduled to consider a planning application for Planning Permission in Principle for the erection of a dwellinghouse on land to the south of Broom Lodge, 10 Broombank Terrace, Braemar1. The application site is located within the Braemar settlement boundary and conservation area. While the Cairngorms National Park Local Development Plan Policy 9 generally does not consider Planning Permission in Principle appropriate in conservation areas, the applicant was seeking a departure from this policy. The report indicated that the proposal was unlikely to have an adverse impact on the character or appearance of the Braemar Conservation Area, and a recommendation for approval was made, subject to conditions and the payment of developer obligations.
Lumphanan Hall Asset Transfer
A significant item on the agenda was the consideration of an Asset Transfer Request (ATR) from the Lumphanan Hall Association (LHA) to take over the Lumphanan Hall as a community asset2. The LHA proposed to maintain and develop the building for the benefit of the community. The council's Marr CAT Steering Group had reviewed the ATR and was of the view that it should be allowed to proceed. The report outlined the valuation of the property, the business plan submitted by the LHA, and the potential community benefits, including economic development, regeneration, public health, social wellbeing, and environmental wellbeing. The committee was recommended to agree to the asset transfer for a nominal consideration of £1, subject to specific conditions related to secured start-up funding, financial monitoring, and plans for managing repairs.
School Capacity, Reserved Places and Admission Limit Policy
The committee was also scheduled to consider and comment on the draft School Capacity, Reserved Places and Admission Limit Policy3. This policy consolidates historic arrangements and establishes a consistent, transparent, and evidence-based methodology for determining school capacities, reserved places, and admission limits across Aberdeenshire's primary and secondary schools. The policy aims to support effective planning and management of the school estate, ensure equitable access to school places for in-zone pupils, and facilitate workforce and financial planning. Feedback from various stakeholders, including head teachers, Quality Improvement Officers, and Trade Union Representatives, had been supportive of the policy, particularly regarding safeguarding spaces within schools.
Public Sector Equality Duty
As is standard practice, the committee was scheduled to consider its Public Sector Equality Duty4. This involves having due regard to the need to eliminate discrimination, harassment, and victimisation; advance equality of opportunity; and foster good relations between those who share protected characteristics and those who do not. Where an Integrated Impact Assessment (IIA) was provided, members were to consider its contents when reaching a decision.
Exempt Information
The committee was also scheduled to consider items of business that might involve the disclosure of exempt information, with the public and media representatives potentially being excluded from the meeting for these specific items5.
