The Appeals Sub Committee of Aberdeen City Council met on Wednesday 30 September 2026 to consider an employee dismissal appeal. The committee heard submissions from both the appellant and management, and after deliberation, resolved by a majority of three to two not to uphold the appeal, thereby upholding the appellant's dismissal from employment.
Appeal 26/06
The Sub Committee considered an appeal against the decision of Aberdeen City Council to dismiss an employee, identified as appeal 26/06. The committee reviewed the submitted documentation and heard arguments from both the management representative and the appellant, who was accompanied by a trade union representative. Following questioning of both parties by the committee members, closing statements were made. The Sub Committee then deliberated in private and reconvened to announce its decision. By a majority of three votes to two, the Sub Committee resolved not to uphold the appeal, thereby upholding the appellant's dismissal from employment with Aberdeen City Council.
The procedure for appeals is outlined in the Appeals Sub Committee Procedure document. This procedure details that the Appeals Sub Committee reviews the fairness of decisions made by Council officers, rather than re-hearing the case to make a fresh decision. Points for consideration include the appropriateness of the penalty, extenuating circumstances, procedural matters, new evidence, potential precedent, and compliance with legislative requirements. The Sub Committee is authorised to revoke, confirm, or vary the decision being appealed against. In this instance, the decision was to confirm the original decision to dismiss the appellant.
