The Licensing Sub-Committee was scheduled to consider an application for a new premises licence for Shah's Halal Food, located at 302 Green Lanes, London, N13 5TT. The applicant, Grill Aura Limited, was seeking permission for late-night refreshment to be available from 23:00 to 04:00 daily. The premises is situated within the Palmers Green Cumulative Impact Zone1.
Representations were received from a Palmers Green ward councillor and the Green Lanes Business Association (GLBA), both raising concerns about the potential for public nuisance, particularly regarding the proposed late hours. The GLBA specifically objected to the 04:00 terminal hour, suggesting that late-night refreshment should conclude no later than 01:00 from Monday to Saturday and 23:00 on Sundays and Bank Holidays. They highlighted that the premises has residential accommodation above and that the current planning permission2 for the site imposes earlier operating hours, with a condition stating that the takeaway use shall only operate between the hours of 11:00am and 1:00am on Mondays to Saturdays, 11:00am and 11:00pm on Sundays or Bank Holidays,
imposed to protect the amenities of adjoining occupiers.

The applicant, Grill Aura Limited, had responded to these representations, agreeing to a revised operating schedule. Under these proposed conditions, the premises would be closed to the public for purchases or collections after 01:00 from Sunday to Wednesday and after 02:00 from Thursday to Saturday. However, delivery orders would still be permitted until 04:00. The applicant also stated that the Metropolitan Police and Licensing Enforcement had been consulted and were satisfied with the adjusted hours and proposed operating schedule, which included measures for staff training, CCTV operation, incident logging, considerate driver conduct, litter prevention, and child protection. The applicant also referred to nearby 24-hour gambling premises and another 24-hour food outlet as part of the local context.
The report pack indicated that the Metropolitan Police and the Licensing Authority had initially made representations but withdrew them after the applicant agreed to amended conditions.

A Cumulative Impact Zone (CIZ) is an area identified by a local council where there is a high concentration of licensed premises, and where the council believes that the cumulative effect of these premises is likely to lead to increased crime, disorder, public nuisance, or harm to children. In such zones, new applications for licences or variations that could add to the cumulative impact may face a rebuttable presumption of refusal unless the applicant can demonstrate that their operation will not exacerbate the problem. ↩
-
Planning permission is a separate regulatory process from licensing. It governs land use and development, including the hours of operation for businesses, based on factors such as the impact on the local environment and amenities. ↩

This condition is detailed in Appendix A of the Green Lanes Business Association's supplementary response, available within the public reports pack. ↩
