Licensing Sub Committee B was scheduled to consider an objection to a Temporary Event Notice (TEN) for The Den
on Baker Street, Middlesbrough. The TEN sought to extend licensable activities until 2:00 am on Sunday, 8 November 2026.
Objection to Temporary Event Notice at The Den
The committee was scheduled to consider an objection raised by Middlesbrough Council's Environmental Health team regarding a Temporary Event Notice (TEN) for The Den,
located at 15 Baker Street, Middlesbrough, TS1 2LF. The TEN, submitted by Adam Duce, a director of The Den Middlesbrough Limited, proposed extending licensable activities, including the sale of alcohol and the provision of recorded music and dancing, from midnight to 2:00 am on Sunday, 8 November 2026.
The objection from Environmental Health was based on the grounds of preventing public nuisance. The report pack indicated that Baker Street is situated within an area designated as a Cumulative Impact area in the Council's Licensing Policy. This designation is applied where a high density of licensed premises is considered to have a detrimental effect on licensing objectives, potentially leading to disorder and nuisance. The policy generally leads to the refusal of applications that would add to this cumulative impact.
The report pack highlighted that while the area was initially regenerated to include micro pubs, restaurants, and cafes with a terminal hour of midnight, some venues have since introduced DJs and karaoke. Environmental Health officers have reportedly carried out investigations and noise monitoring in Baker Street, identifying issues with licensed premises exceeding acceptable noise levels and operating outside permitted hours. Discussions have taken place between council officers and licensees, including representatives from The Den, to advise against further extensions to licensable hours in the area.
The Environmental Health Officer, Emma Tindall, Public Protection Manager, had indicated that further evidence would be provided to support the objection. The report pack outlined that the Licensing Sub-Committee, which was scheduled to include Councillor Stephen Hill (Chair), Councillor Christine Cooper (Deputy Group Leader), and Councillor Anne Romaine, would need to consider the objection notice and any representations made. The committee had the option to allow the licensable activities as stated, impose conditions on the TEN, or issue a counter notice, which would mean the event could not proceed as planned.
The report pack also included the Temporary Event Notice application form submitted by Adam Duce, detailing the proposed activities, times, and maximum number of attendees. Additionally, a copy of The Den's existing Premises Licence was provided, outlining its authorised licensable activities and operating hours. The objection notice itself, signed by Emma Tindall, detailed the reasons for the objection, stating that the proposed extension would likely generate noise that would adversely affect nearby residents, given the proximity of residential dwellings and previous complaints.
The meeting was scheduled to be held in the Mandela Room at the Town Hall. Members of the public were informed of their right to film, record, or photograph the proceedings, provided it did not disrupt the meeting.
