Summary

Open Council Network is an independent organisation. We report on East Riding of Yorkshire and are not the council. About us

The Western Area Planning Sub-Committee was scheduled to consider two planning applications, one for agricultural land in Bubwith and another for a former highway depot in Market Weighton. The committee was also scheduled to receive information on recent planning appeal decisions.

Planning Application: Highfield Road, Bubwith

The Sub-Committee was scheduled to consider a planning application for the erection of 12 affordable dwellings, with new access and landscaping, at Highfield Road Agricultural Land in Bubwith. The application, number 25/01833/REG3, was submitted by East Riding of Yorkshire Council. The recommendation was for deferral to secure agreements on affordable housing, on-site open space provision and maintenance, and off-site contributions for outdoor space and children's and young people's spaces. Subject to these agreements, the application was to be approved with conditions.

The report detailed key policies from the East Riding Local Plan Strategy Document Update and the National Planning Policy Framework that were relevant to the application, including those concerning focusing development, providing public open space, high-quality design, landscape, biodiversity, environmental hazards, sustainable transport, and the Vale of York sub-area. The East Riding Design Code was also referenced.

Consultation responses were scheduled to be reviewed, including those from Yorkshire Water, Bubwith Parish Council, the Transport Planning Team, Environmental Control, the Environment Agency, Natural England, Ouse And Humber Drainage Board, the Nature Conservation Officer (Biodiversity), the Open Space Working Group, Humberside Police, Housing Strategy and Development, Land Drainage, the Lead Local Flood Authority, Humberside Fire and Rescue Service, and the Historic Environment team.

The planning assessment was scheduled to cover the principle of development, housing matters (including affordable housing mix and tenure, and housing density), public open space, design and area character, living conditions, ecology and biodiversity, flood risk and drainage, access and highway safety, and archaeology. The report highlighted that the application site falls within the housing site allocation BUB-D and that the proposed development comprises 100% affordable housing, exceeding the minimum policy requirement. Concerns raised by Bubwith Parish Council regarding drainage capacity and the safety of an open ditch were noted.

The report also detailed numerous conditions that were to be imposed if planning permission were granted, covering aspects such as the commencement of development, noise assessments, drainage, construction traffic management, construction method statements, environmental management plans for biodiversity, landscape proposals, management plans for ecology, archaeological investigations, wildlife enhancement plans, information provision to avoid recreational disturbance, lighting plans, construction hours, land contamination, service road provision, enclosure means, cycle parking, vehicular access, external materials, biodiversity gain reporting, air source heat pump standards, on-site amenity space provision, affordable housing occupation, and approved plans.

Planning Application: Former Highway Depot, Holme Road, Market Weighton

The Sub-Committee was scheduled to consider a planning application for the erection of four dwellings following the demolition of existing buildings at the Former Highway Depot, Holme Road, Market Weighton. The application, number 26/02069/PLF, was submitted by Riding Homes Ltd. The recommendation was for approval with conditions.

Relevant policies from the East Riding Local Plan Strategy Document Update, the East Riding Design Code, and the National Planning Policy Framework were scheduled to be considered. These included policies on supporting development in villages and the countryside, integrating high-quality design, promoting a high-quality landscape, biodiversity, environmental hazards, housing mix, efficient land use, and sustainable transport.

Consultation responses from Market Weighton Town Council, the Transport Planning Team, Environmental Control, Yorkshire Water, the Nature Conservation Officer (Biodiversity), Housing Strategy and Development, Land Drainage, and the Historic Environment team were to be reviewed. An objection from an occupant of Oaklea, 5A Lister Gardens, Market Weighton, concerning tree removal, access standards, potential impact on Yorkshire Water infrastructure, and parking and bin collection areas was also to be considered.

The planning assessment was scheduled to address the principle of development, housing mix, design and impact on the character of the area, living conditions, access, parking and highway safety, flood risk/drainage, ecology and biodiversity, and archaeology. The report noted a shortfall of one-bedroom dwellings in Market Weighton and that the proposal included four one-bedroom apartments intended as affordable housing, although no policy requirement for affordable housing applied due to the scheme's scale.

Conditions were to be imposed, including those relating to the commencement of development, construction traffic management plans, construction environmental management plans, wildlife enhancement plans, tree protection measures, retained tree protection, construction hours, drainage implementation, cycle parking, vehicular access, ecological mitigation measures, obscure glazing for specific windows, archaeological written schemes of investigation, and approved plans. The application was noted to be exempt from statutory Biodiversity Net Gain requirements due to its size.

Planning Appeal Decisions

The Sub-Committee was scheduled to receive information on several planning appeal decisions for noting:

  • 2 Westparkside, Goole: An appeal against the refusal of planning permission for the retrospective erection of a boundary fence (1.52m in height) was dismissed. The Inspector found the fence to be a tall and visually prominent feature that was uncharacteristic of the area and detracted from its openness.
  • 11 Windermere Drive, Goole: An appeal against the refusal of prior approval for a single-storey rear extension was dismissed. The Inspector concluded that the extension, due to its height, depth, and flat-roofed design, was scheduled to result in a strong sense of enclosure and an unacceptable effect on the outlook from a primary habitable room window of the neighbouring property.
  • Unit 16, Wesley Square, Goole: An appeal against the refusal of express consent for the removal of one poster advertisement and the upgrade of an existing 48-sheet advert to support a digital poster was dismissed. The Inspector found that the proposed digital display was scheduled to be visually intrusive and detrimentally affect the historic townscape of the Goole Conservation Area.
  • Land at Mill Lane, Sandholme: An appeal against an enforcement notice concerning the change of use of land to a haulage and storage yard for aggregates, including the erection of entrance gates, gravelled surfacing, parking bays, a portable site office, a storage container, and aggregate storage bays, was allowed with conditions. The Inspector found the site suitable for the limited scale of development and concluded that, subject to conditions, the visual effect was scheduled to be localised and acceptable.
  • Grange Farm, Laytham Road, Foggathorpe: Appeals against an enforcement notice alleging the erection of four dwellinghouses and associated material change of use of agricultural land to residential use were dismissed. The Inspector found that the works constituted the erection of new buildings rather than the conversion of existing ones, and that the material change of use was not supported by development plan policies. The notice was upheld with variations to the compliance periods and the removal of the demolition requirement.

The agenda also included standing items such as declarations of interest and the approval of minutes from the previous meeting, as well as a notification of any withdrawn applications.
